DGT's radar fines under scrutiny
A judge in Cordoba has annulled a fine because the speed camera that caught the car only took a photograph of the offence. The DGT used the same photo and cropped it, which makes the proof worthless according to the ruling and the fine of 100 euros is annulled.
The offence was detected by a fixed speed camera in Córdoba. They have also been ordered to pay the costs of the trial for 'bad faith'. The reason is clear: this camera had not taken two different images.
When the DGT notifies a traffic fine it must send two photographs, one panoramic to see both the lane and the car, and another taken at a different time showing the number plate close up.
This should be the case for all traffic fines. As the DGT used the same cropped photograph, the ruling of this Cordoba judge favoured the driver.
